Terms of Service

1. Acceptance of Terms

By accessing or using the Service you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If a change materially reduces your rights, we will provide reasonable advance notice (for example, by email or an in-app banner).

2. Description of the Service

Jobapply.io is a software-as-a-service platform that helps individuals create, edit, manage, and export professional resumes, CVs, and cover letters. The Service includes a web application, template library, AI-assisted writing tools, document export functionality, and related features.

This marketing website (jobapply.io) describes the product and links you to the product application (app.jobapply.io). Both surfaces are part of the Service.

3. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By creating an account, you represent and warrant that:

• You are legally capable of entering into a binding agreement.
• You are not barred from using the Service under any applicable law.
• If you act on behalf of an organization, you have the authority to bind that organization to these Terms.

4. Account Registration and Security

To access most features you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are solely responsible for maintaining the confidentiality of your account credentials, including passwords and magic-link emails. You agree to notify us immediately athello@jobapply.io if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that appear to be compromised, fraudulent, or in violation of these Terms, with or without prior notice where necessary for security or legal reasons.

5. Free and Paid Plans

5.1 Free Plan

The Service may offer a free plan with limited features. We reserve the right to modify the scope of the free plan at any time. Free plan users are subject to the same obligations as paid users under these Terms.

5.2 Paid Plans and Trials

Paid plans and optional trial periods are described on our pricing page. By subscribing to a paid plan you authorize us to charge the payment method you provide at the stated price, including any applicable taxes. Prices are displayed inclusive or exclusive of tax depending on your location.

5.3 Automatic Renewal

Paid subscriptions renew automatically at the end of each billing cycle (monthly or yearly) unless you cancel before the renewal date. You will be charged the then-current price for the renewal period. We will send a renewal reminder in accordance with applicable law.

5.4 Price Changes

We may change subscription prices. Any price change will take effect at the start of the next billing cycle following notice. If you do not agree to the new price, you may cancel before the next billing cycle begins.

6. Cancellation, Refunds, and Right of Withdrawal

6.1 Cancellation

You may cancel your subscription at any time through your account billing settings or by contacting support. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.

6.2 Refunds

Refunds are handled on a case-by-case basis. If you believe a charge was made in error, contact us within 14 days of the charge. We will review the request and respond within a reasonable timeframe. Refund eligibility may depend on usage, plan type, and applicable consumer protection law.

6.3 EU/EEA Right of Withdrawal

If you are an EU/EEA consumer, you have the right to withdraw from a distance purchase within 14 days of the transaction date without giving a reason, unless you have expressly consented to immediate performance of the Service and acknowledged that doing so waives your right of withdrawal.

To exercise your right of withdrawal, send a clear statement tohello@jobapply.io including your name, email address, order reference, and the date of the transaction. We will process the refund within 14 days using the same payment method you used for the original transaction.

7. User Content and Ownership

7.1 Your Content

You retain all ownership rights in the content you create, upload, or import into the Service ("User Content"), including resume text, cover letters, profile information, and uploaded files. We do not claim ownership of User Content.

7.2 License to Us

By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, process, display, and transmit your User Content solely for the purpose of providing and improving the Service. This license ends when you delete your User Content or close your account, except to the extent we are required to retain data by law.

7.3 Responsibility for Content

You are solely responsible for the accuracy, legality, and appropriateness of your User Content. You represent that you have the necessary rights to any text, images, or materials you include in your documents.

8. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right.
• Upload, transmit, or store content that is defamatory, obscene, fraudulent, or harmful.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
• Distribute malware, viruses, or any code designed to interfere with the Service.
• Attempt to gain unauthorized access to other accounts, the Service infrastructure, or connected systems.
• Scrape, crawl, or use automated means to access the Service except as permitted by our robots.txt.
• Reverse-engineer, decompile, or disassemble any part of the Service, except as permitted by applicable law.
• Resell, sublicense, or redistribute the Service or any part of it without written permission.
• Use the Service to build a competing product, benchmark the Service for competitive purposes, or copy the template library for redistribution.
• Send unsolicited commercial messages, spam, or bulk communications through the Service.
• Overload the Service with excessive automated requests or otherwise degrade the experience for other users.

We reserve the right to investigate and take appropriate action (including suspension or termination) if we have reason to believe you have violated these rules.

9. Intellectual Property

9.1 Our Rights

The Service, including its design system, template library, source code, branding, user interface, documentation, and all related intellectual property, is owned by Jobapply ApS or its licensors and is protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License to You

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes. This license does not include the right to sublicense, modify, or make derivative works of the Service.

9.3 Template Usage

You may use our templates to create your own personal documents (resumes, CVs, cover letters). You may not extract, copy, or redistribute the templates or template library as a standalone product or collection.

9.4 Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback in any way without obligation to you.

10. AI-Assisted Features

The Service may include AI-powered features (such as content suggestions, rewriting assistance, or skill recommendations). These features are provided as aids and do not constitute professional career advice. You are responsible for reviewing and approving all AI-generated output before using it in your documents.

AI-generated content may be inaccurate or incomplete. We do not guarantee the quality, accuracy, or suitability of AI suggestions. You should not rely on AI features as a substitute for your own judgment.

11. Third-Party Services

The Service may integrate with or contain links to third-party services (for example, payment processors, hosting providers, AI model providers, and analytics tools). These third parties have their own terms of service and privacy policies. We are not responsible for the content, policies, or practices of third-party services.

Our use of third-party AI model providers is subject to their acceptable use policies. We do not share your personal data with AI model providers beyond what is necessary to deliver the requested feature, and we do not use your content to train third-party models.

12. Service Availability and Modifications

We strive to keep the Service available and functioning reliably, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance, unexpected outages, network issues, and force majeure events may affect availability.

We may modify, update, or discontinue features or parts of the Service at any time. If we discontinue the entire Service, we will provide reasonable notice (at least 30 days) so you can export your data.

13. Data Export and Portability

You may export your documents from the Service in supported formats (such as PDF) at any time while your account is active. Upon account closure, we will retain your data for a reasonable period to allow recovery if needed, after which it will be deleted in accordance with our Privacy Policy.

14. Termination

14.1 By You

You may close your account at any time by using the account settings or by contacting support. Closing your account cancels any active subscription at the end of the current billing period.

14.2 By Us

We may suspend or terminate your account if you materially breach these Terms, engage in prohibited conduct, fail to pay amounts due, or if we are required to do so by law. Where feasible, we will provide prior notice and an opportunity to cure the breach, unless immediate action is required for security, legal, or fraud prevention reasons.

14.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will remain in effect.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) results obtained from the Service will be accurate or reliable; or (d) any defects will be corrected.

Jobapply.io provides tools for document creation and job application management. We do not guarantee interview invitations, job offers, salary outcomes, or any particular employment result. You remain solely responsible for the content you submit to employers and the decisions you make during your job search.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JOBAPPLY APS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the amounts you have paid us in the 12 months preceding the claim; or (b) EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

17. Indemnification

You agree to indemnify, defend, and hold harmless Jobapply ApS and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right.

18. Privacy

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, store, and share your personal data. Our Cookie Policy explains how we use cookies and similar technologies.

19. Communications

By creating an account, you consent to receive Service-related communications from us by email, including account notifications, billing confirmations, security alerts, and product updates. You may opt out of non-essential marketing emails at any time using the unsubscribe link.

You are responsible for keeping your account email address up to date so you receive important communications about your account, billing, and the Service.

20. Governing Law and Dispute Resolution

20.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions. If you are an EU/EEA consumer, nothing in these Terms affects mandatory consumer protection rights available under the laws of your country of residence.

20.2 Dispute Resolution

We encourage you to contact us first at hello@jobapply.io to resolve any dispute informally. If a dispute cannot be resolved informally within 30 days, it shall be submitted to the competent courts of Copenhagen, Denmark, subject to any mandatory consumer jurisdiction rules.

20.3 EU Online Dispute Resolution

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

21. General Provisions

21.1 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Jobapply ApS regarding the Service, and supersede all prior agreements and understandings.

21.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

21.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us to be effective.

21.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.

21.5 Force Majeure

Neither party shall be liable for failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, pandemic, war, terrorism, riots, government actions, power failures, internet disruptions, or similar events.

21.6 No Third-Party Beneficiaries

These Terms do not confer any third-party beneficiary rights. They are between you and Jobapply ApS only.
